Upon booking with me, you agree to these terms and conditions (you will sign a contract with the same terms and conditions outlined below) – so before your session, make sure you have had a read through and understand them.

WEDDING TERMS & CONDITIONS

1. Entire Agreement

1.1 ENTIRE AGREEMENT: This agreement contains the entire understanding between the photographer and the client(s). It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.

1.2 PHOTOGRAPHER’S AGREEMENT: On both parties signing the contract, Emily Crutcher Photography agrees to reserve the time agreed upon and not make another reservation at these specified times. For this reason, all deposits/fees are non-refundable if the shoot is cancelled by the client.

2. The Booking

2.1 CONFIRMING THE BOOKING: A fully signed “Wedding Photography Contract” and full payment of the non-refundable booking fee (also referred to as the “deposit” or “non-refundable deposit”, due upon invoice receipt) are required to confirm the services provided by this photographer.

2.2 CANCELLATION / COOLING OFF PERIOD: Post entering into this contract you have 14 days of the cancellation period. During this time you have the right to cancel your booking without any charge and your fee will be refunded to you.

2.3 PRE-WEDDING CONSULTATION: Every client is entitled to a pre-wedding consultation in which we can discuss your ideas and needs to meet for the shoot so the photographer can ensure she provides adequate service—this is usually done by email but can be arranged in person at the photographer’s choice of location or via Skype. The client is welcome to another consultation closer to the shoot if necessary and is welcome to ask as many questions as needed via phone or email and the photographer will endeavour to answer at her best ability.

2.4 CANCELLATION / NON-PAYMENT: If the client(s) cancel the booking for any reason he or she agrees to forfeit the non-refundable booking fee and any monies paid to the photographer. This money is proportional to the amount of time remaining before the wedding date.

2.4.1 CANCELLATION OVER 12 MONTHS AWAY: If the client’s scheduled wedding date is more than 12 months away, the photographer agrees to refund 75% of any monies already paid towards the booking, EXCLUDING the non-refundable booking fee.

2.4.2 CANCELLATION OVER 9 MONTHS AWAY: If the client’s scheduled wedding date is more than 9 months away, the photographer agrees to refund 50% of any monies already paid towards the booking, EXCLUDING the non-refundable booking fee.

2.4.3 CANCELLATION UNDER 9 MONTHS AWAY: No monies will be refunded to cancellations where the wedding date is less than 9 months from the date of cancellation. This is to protect the photographer from loss of earnings in cases where a date has been reserved and the photographer has turned away other clients from booking on that date.

2.5 NON-PAYMENT: If the clients refuse to pay the final balance, the photographer reserves the right to decline to provide any further services, prints or merchandise unless or until the balance is paid. The client shall also forfeit any moneys already paid to the photographer. The photographer shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the shoot or event.

2.6 RESCHEDULING: If the client reschedules their wedding date and on the new date, Emily Crutcher Photography is no longer available, the client forfeits any and all monies already paid to the photographer including the booking fee. If the client reschedules their wedding and the photographer is available, they are welcome to use their booking fee towards this new date, but will be required to pay an additional rescheduling fee. The client agrees to pay this rescheduling fee of £100 should they reschedule their date at any point.

2.7 LATE PAYMENT / PENALTY FEES: The client(s) agree to pay the remaining balance no later than 28 days before the day of the booked shoot. If the fee is unpaid, the photographer reserves the right to withhold any services, images and merchandise. There is a 30% late payment fee for any payments that are not postmarked or delivered to Emily Crutcher Photography by the required date, which will be calculated based on 30% of the client’s final balance. If the booking is made with less than 28 days before the day of the booked shoot, the full balance is due immediately to reserve the date. If this balance is not paid immediately, the session is not reserved.

2.8 COOPERATION AND PUNCTUALITY: The client(s) and the photographer consent to cooperate and communicate happily with each other to achieve the best possible shooting results. The client understands that failure to be punctual can result in loss of shooting time. If the clients are late or a schedule overruns, the photographer will do her best with the time she has to compensate and produce the best results she can in the time allotted.

2.9 RESPONSIBILITIES: The photographer is not responsible for compromised coverage due to causes beyond the control of the photographer including but not limited to obtrusive guests, lateness of the client or guests, weather conditions (The photographs will be taken as agreed permitting the weather is agreeable with the shoot. In the event of obstructing bad weather, the photographer and the client(s) will make necessary changes to the schedule or rebook if necessary.), natural disasters or an “Act of God”, schedule complications, incorrect addresses provided to the photographer, rendering of decorations, or restrictions of the locations. The photographer is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The photographer is not held liable for missed coverage of any part of the event(s). The photographer will not be held accountable for failure to deliver images of any individuals or any objects at the event(s) unless previously written in agreement.

2.10 VENUE / VENUE & LOCATION PERMITS: The client is responsible for acquiring all permits and necessary permission for all locations on which the photographer will be performing services. The photographer is limited by the rules and guidelines of the location(s) and site management. The client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the client’s responsibility; the photographer will offer technical recommendations only. NOTE: Some churches are very specific about their regulations for photography, although can be open to negotiation. Please check with your vicar or church coordinator in advance as to their stance on discreet / non-discreet photography. NOTE: I do not usually use flash in church, so there should be no bright disturbances.

2.11 LIABILITY: If for any reason the photographer is unable to provide the photographic services detailed in this contract due to unforeseen circumstances she will: do her best to find another photographer to replace her. If no replacement can be found, either a re-booking will be offered or the option to refund the entire fee including the non-refundable booking fee. Under the extremely unlikely circumstances that images may be lost, stolen or damaged beyond the photographer’s control, including but not limited to camera or equipment malfunction, liability is limited to the photographer returning any money paid to her for the service or part of said money thereof according to the percentage of images supplied. The photographer is not liable to deliver every image taken. The decision of images delivered is at the discretion of the photographer.

2.12 NON GUARANTEE: Although every possible care will be taken to produce photographs of all important and special events during the wedding, the photographer cannot place an unconditional guarantee on the above. The photographer will not be held responsible for any ruined photographs due to guests’ (or any other) flashes; or any other ruined photographs due to any other cause outside of the photographer’s control.

2.13 SAFETY: The photographer reserves to right to terminate coverage and leave the location of the event(s) if the photographer experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the event(s); or in the event that the safety of the photographer is in question.

2.14 COMPLAINTS: Please address any complaints to Emily Crutcher Photography in writing either by email to hello@emilycrutcher.co.uk or letter to 23 Henry Street, Rainham, Kent, ME88HE. The photographer will endeavour to respond to any complaints within 48 hours of receipt.

2.15 PRIVACY: Emily Crutcher Photography stores your name and details on a private database. These details will not be made public or shared with any companies or individuals outside of Emily Crutcher Photography.

3. The Coverage

3.1 TIME LIMITS: “Full Day Coverage” or “Full Day” photography includes up to 10 consecutive hours or until 1 hour after the first dance, whichever is sooner. It usually begins during bridal preparations (approx. 1.5-2 hours before ceremony) – or 30 minutes before the ceremony if the client does not wish to have bridal prep/groom prep coverage. “Half Day” coverage constitutes up to 3 consecutive hours of coverage and no more. This coverage cannot be split up or partitioned over one or more days, and should be one block of allotted time unless otherwise stated by the photographer. This coverage is only available in off-peak season (November – March) unless otherwise stated by the photographer. “Small Day” coverage constitutes up to 5 consecutive hours of coverage and no more. This coverage cannot be split up or partitioned over one or more days, and should be one block of allotted time unless otherwise stated by the photographer. This coverage is only available in off-peak season (November – March) unless otherwise stated by the photographer. “Late Finish” coverage constitutes of 3 consecutive hours extra coverage or until Midnight, whichever is sooner. This coverage cannot be split up or partitioned over one or more days, and should be one block of allotted time unless otherwise stated by the photographer. “Early Start” coverage begins 3 consecutive hours prior to the agreed upon start time. This coverage cannot be split up or partitioned over one or more days, and should be one block of allotted time unless otherwise stated by the photographer.

3.2 SOLE PHOTOGRAPHER: The contracted photographer shall be the sole photographer booked at the event. Client acknowledges that the presence of other photographers (professional or amateur, please also make guests aware of this rule) may adversely impact the ability of the photographer to create the work and as a result the work may fail to meet the standards represented by the photographer in it’s portfolio and samples. The only second or assistant photographers allowed in exception to this rule should be previously vetted and contracted by Emily Crutcher Photography to ensure there is no conflict of interests and ensure the quality of work is not impaired or negatively influenced. The photographer reserves the right to immediately protect their interests, including but not limited to a cessation of the assignment, leaving the assignment location(s) and/or terminating this agreement. In such circumstances, the photographer will not refund any monies paid by the client. The client shall indemnify the photographer from any such missed images from the event. While the photographer welcomes guests to take photographs (should you not be having an unplugged wedding), however, please ask that your guests are mindful that the photographer has been paid to do a job (not standing in the way of shots, allowing the photographer to work uninterrupted) and be aware that guests with cameras or camera phones can impair a professional’s candid shot that may be impossible to recreate. The client acknowledges that they are responsible for notifying all guests to be respectful of the professional photographer in session and that if they allow guests to photograph during the session, this may lead to loss of shots or quality. The photographer’s request in these instances is to advise the couple to ask that guests do not take shots until the ceremony and group shots are finished – and to consider booking a second professional photographer with Emily Crutcher Photography should they want additional shots from another perspective. However, this is up to the client’s discretion to mind and decide whether they want guests to take photographs or not, providing that guests are mindful and respectful of the photographer’s own work.

3.3 ASSISTANT / SHADOW PHOTOGRAPHERS: The photographer reserves the right to involve a pre-selected second photographer or production assistant, should she choose to for her own reasons. This should not affect any charges incurred to the client. This may be used to (but is not limited to) training other photographers in the industry, capture the event from a second perspective and/or to assist the photographer in shots that may require a second person to set up. The operator in question will be previously vetted and contracted by Emily Crutcher Photography. If the client wishes to have a second photographer for their day and receive the images, they may book one. There is a £250 fee for a second photographer for Full Day Coverage. For groom preparation coverage only (while the photographer shoots bridal preparations, the second photographer will take charge of groom preparations) there is a fee of £100.

3.4 EVENT SCHEDULE: The client(s) agrees to confirm the schedule at the latest 1 week prior to the booked date. Notification of any changes to the schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the company by the client. The photographer will include a designated questionnaire, in which the client can submit their schedule and further details about the wedding.

3.5 MEALS: The photographer does not require that the client provides them with a meal, although it is always appreciated. If the client does not wish to provide the photographer with a meal, the photographer expects that the client will allow them a break during the wedding meal. During the wedding meal / wedding breakfast, the photographer will take their break. If there is not food available on the premises, the photographer (and any assistant or second photographer) may leave briefly for lunch and return. Emily Crutcher Photography does not normally take photographs of guests or clients eating food, hence this is the opportune time for a break.

4. Image Delivery

4.1 IMAGE DELIVERY: The final images provided by the photographer will be delivered within approximately 10 weeks of the wedding date. Depending on the season and workload of the photographer, some projects may be delivered sooner than this allowed time. All bookings include delivery via an online gallery with the ability to download and share images. The link (and password) to this gallery will be provided in an email once your images are ready. This online gallery will be active for 6 months. The client agrees to download this gallery prior to the gallery expiration date. If you are booking the standard package or above and are also receiving a USB, you will receive a thank you packet with the printed details of your digital download / sharing gallery in also. You can order thank you cards with the URL, password and details of your digital gallery on to hand out to guests at your wedding for an additional cost. If prints, albums or products are included in your pre-paid package, you will be able to select images and finalize your order as soon as you receive your digital gallery or USB.

4.2 USB: The client(s) understands that the USB(s) are for delivery and that the client is responsible for making a back up of their images. If the client loses the images through failure to back up the files, there is an extra charge for a replacement USB. Once your online gallery has expired, there is a £15 fee to re-open your gallery for download and sharing. I can alternatively post a USB drive of your wedding images. This service costs £50 including shipping, labour and product cost.

4.3 COPYRIGHT LAW: English Copyright Law declares that the copyright remains with the photographer. The photographer grants the client(s) permission to make copies of the images under the following conditions: The images taken by the photographer are for personal use by the client and their friends or family; selling the photographs is not allowed without permission from the photographer. The client(s) will not have access to any unedited raw image files. The Photographer has unrestricted use of these images and can use them wholly or in part in any publication (commercial or otherwise), portfolio or public display with any retouching or alteration without restriction. At events, it is the client’s responsibility to notify guests of this unrestricted use; that attending the event acts as a model release. The client(s) hereby assigns the photographer the irrevocable and unrestricted right to use and publish photographs of the client(s) or in which the client(s) may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The client releases all claim to profits that may arise from use of images. Buyer may not resell, relicense, redistribute without express written permission from photographer. Use as a derivative work, and reselling or redistributing such derivative work is prohibited. Images may not be edited or have filters applied to them. Images may not be used in a pornographic, obscene, illegal, immoral, libellous or defamatory manner. Images may not be incorporated into trademarks, logos, or service marks. Images may not be made available for download.

4.4 STYLE: The final post production styles, overall look and editing are left to the discretion of the photographer with the exception of specific requests the client has made to the photographer in writing, and the photographer has agreed to.

4.5 RETOUCHING, CONVERSIONS AND DIGITAL FILES: Files are automatically lightly retouched and processed to my signature style, and are available in colour and black and white for no added fee. Complex retouching may result in an additional fee. Emily Crutcher Photography, through post production, shall not be performing any of the following: I cannot make you taller or shorter. I cannot change the colour of your hair, eyes, skin tone etc. beyond any full image treatment such as B&W. I cannot superimpose different clothing on your body. I cannot add trademarked/copyrighted images, materials, people, places, or things, such as Mickey Mouse or Justin Beiber. I cannot produce any images which include defamatory or degrading depictions or language of any kind, illegal acts, or in any way compromise our professional or personal reputations. The photographer does not include editing of difficult appearance factors beyond their control, such as visible and prominent tan lines, in every photo, however if there is a serious issue such as this that needs fixing, the client is allowed to optionally select 10 photos in which they would like the tan line, “double chin” or other complicated issue editing from and the photographer will fix these free of charge. Additional photos will be subject to a fee for editing per photo.

4.6 FILE TYPE: The photographer will not supply any unedited or unprocessed RAW files. The photographer will only supply images edited at a standard that the photographer deems appropriate. The client understands that any additional image editing/retouching may incur additional charges.

4.7 18-MONTH TERMINATION CLAUSE: The photographer reserves to right to terminate album, product or prints orders if after 18 months from the date of the wedding, the client has not selected their images, product specifications and finalised their order with the photographer.

4.8 PRINT/VIEWING GUARANTEE: Emily Crutcher Photography can only guarantee the quality and look of prints and print products that are produced and sold by Emily Crutcher Photography. If you choose to print your digital files via a third party, budget or supermarket printer, the quality of your images may be impaired and your printed images may look discoloured, over-done or different to how they appear on-screen and via my professional printing. I do not recommend having your high-quality images printed via a cheap printer for this reason, and you can purchase professional quality products through me and through your gallery, which are 100% guaranteed to look beautiful on your walls or in albums. In regards to viewing guarantees, I cannot guarantee the quality of image viewing on your home monitors or devices that have not been colour calibrated. I recommend that you calibrate your monitor for the best viewing pleasure and image quality.

4.9 ALBUMS & PROOFING: The client has the option of who selects the images for the wedding album, should one be ordered. If the client wants to select their own images, they may do so by adding all selected images to a dedicated favourites list in their online gallery. (Please do this at your earliest convenience.) This should be done within one year of your wedding date. If this is not possible within a year, an additional 10% charge on the overall total of the wedding collection choice will be added and paid before the final order is submitted for production.

4.9.1 CROPPING AND RESIZING: In order to create a bespoke design and tell the client’s story best, it may be necessary to crop and resize certain images in order to facilitate a pleasing design.

4.9.2 PROOFING AND CHANGES: After viewing and selecting your images, they will go through the final edit and a custom designed album will be created for you. A first proof pdf file will be sent to you and you can make as many changes to this proof as you wish with no charge. Any changes made will be completed and a second proof will be sent to the customer for approval. Any further changes will be charged at £25 per page thereafter.

4.9.3 FINALIZING: Once the client has accepted the proof and it is submitted for production, the proof cannot be changed. The client accepts liability for this and agrees to thoroughly check all text, spelling and design before accepting the final proof design.

4.9.4 DELIVERY TIME: Once the album images have been selected and the design proofed and agreed upon, the final delivery time is normally around 12 weeks – although this may be less or slightly more depending on each individual order.

4.9.5 FINAL DELIVERY: The photographer will notify the client once the album is ready for delivery and all final checks have been made.

Emily Crutcher reserves the right to use any photograph in any form such as, but not limited to, advertising, reproduction and copyright. All images are copyrighted by Emily Crutcher Photography, even those you purchase. Copying, scanning, editing or reproducing images is strictly prohibited unless otherwise agreed upon in writing by the photographer. Print-screening images from this website or your proofing gallery without paying for them is also against the law. All offenders will be prosecuted accordingly. Prices are subject to change without notice and are non-negotiable. Due to the custom nature of photographic products, no refunds will be issued. By hiring Emily Crutcher, you agree to these terms.

The Session : The client is guaranteed one portrait session with Emily Crutcher Photography. Portraits with more than one individual may require an assistant. When paying only the £50 retainer fee, the client will recieve a proofing gallery 2-3 weeks after their shoot, from which they can then select digital images, prints and products that they wish to purchase from their session. No images, prints or products are included in the £50 retainer fee. The client can refuse to purchase any images, in which case the gallery will be deleted from the photographer’s hard drive. In this case, any unauthorised screen-shotting or saving of the gallery is illegal. Should the client wish to purchase images from their session, they can do so either by selecting a package to purchase through Emily Crutcher Photography OR buying images and prints individually from their gallery without a package. Should the client decline to purchase images in a package and opt to purchase items individually, the client accepts that there is a minimum spend of £150. Packages start at £150. Digital Images will be delivered (or optional for download) to the client ASAP as soon as full payment for the goods is received. Prints and hard-copy product orders will be delivered or ready for collection within 5 weeks of full payment being received. The £50 retainer fee is deductible from any package or order purchase (over the minimum spend of £150). Travel expenses to location shoots are included within Medway, Kent – outside locations will have an additional small fee to cover my expenses.

Cancellation / Postponement : Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the booking fee(s) and any monies paid are non-refundable. Booking fee(s) are non-transferable unless otherwise agreed upon by the photographer. Forty-eight hours notice of postponements or cancellations is appreciated if it is possible. If the client(s) refuse to pay the final balance, the photographer reserves the right to decline to provide any further services, prints or merchandise unless or until the balance is paid. The client shall also forfeit any moneys already paid to the photographer. The photographer shall have the right to immediately terminate this agreement with no further obligation, retain any monies paid, and not attend the shoot or event. If the client is unwell or unable to attend the session, the client is entitled to postpone / reschedule the session to a date in the near future one time only. If the client wishes to reschedule the session any additional times after this, the client must pay an additional booking fee.

Cooperation and Punctuality / Responsibilities : The client(s) and the photographer consent to cooperate and communicate happily with each other to achieve the best possible shooting results. The client understands that failure to be punctual can result in loss of shooting time. If the clients are late or a schedule overruns, the photographer will do her best with the time she has to compensate and produce the best results she can in the time allotted. No additional time will be added to the session if the client is late. The shoot will start at the scheduled time, any lateness will be deducted from that time. If you are more than 30 minutes late to your session, you forfeit your session and the photographer reserves the right to cancel your session based on her judgement of the situation.
If you are more than 30 minutes late for your appointment the appointment will be cancelled.The photographer is not responsible for compromised coverage due to causes beyond the control of the photographer including but not limited to lateness of the client or others involved, weather conditions (The photographs will be taken as agreed permitting the weather is agreeable with the shoot. In the event of obstructing bad weather, the photographer and the client(s) will make necessary changes to the schedule or rebook if necessary.), schedule complications, incorrect addresses provided to the photographer, rendering of decorations, or restrictions of the locations.

Clients booking newborn sessions should be aware that the session can last 2-4 hours, and make the appropriate arrangements for this. Children and other family members (other than parents) should not be brought along to newborn sessions, with the exception of sibling shots – when sibling shots are captured, they will be captured at the beginning of the session, before the “Baby only” section of the newborn shoot. After this, one parent or family member should exit with the children, leaving just baby, photographer and parent(s). This is to keep a calm, quiet atmosphere for newborn photographs.

Weather : If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.

Cooperation / No Shows : Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions, or for missed images due to details not revealed to Photographer. If Client and/or key individuals fail to appear to a scheduled portrait session, the deposit is non-refundable. The session can be rescheduled at the original portrait session fee, including an additional deposit.

It is the responsibility of the client to ensure everybody is participating in the session. If some partie(s) and/or children refuse to partake, this is not the photographer’s liability. Facial expressions are beyond the control of the photographer. The photographer will try her best to engage with children and clients, but cannot force anybody to smile. If people are not smiling, it is not necessarily considered a bad image. Emily Crutcher Photography will do everything they can to produce good quality images. However, if your baby or child won’t settle or they refuse to participate in the session resulting in little or no images taken then Emily Crutcher Photography cannot be held responsible for this. In this instance Emily Crutcher Photography will offer the chance to re-shoot at a reduced cost (if not already included in the price) at a time suitable for Emily Crutcher Photography although for newborn sessions it cannot be guaranteed that it will be in the 3 weeks time frame.

Exclusive Photographer: The photographer will be the exclusive photographer with no other camera or recording devices, including cell phones or tablets, permitted during your session.

Copyright : English Copyright Law declares that the copyright remains with the photographer. The photographer grants the client(s) permission to make copies of the images under the following conditions:

Copying, scanning or print screening any images unless agreed is strictly prohibited.
Model Release : Client grants to Photographer and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of Client, Client’s child or children, or in which Client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Photographer and her legal representatives and assigns from all claims and liability relating to said photographs

Booking Retainer Fee : Client agrees to pay the non-refundable booking retainer fee of £50.00 to the photographer. A fully signed “Booking Form” and full payment of the non-refundable booking fee (due upon signing this document) are required to confirm the services provided by the photographer.

Location : The client is responsible for acquiring any and all permits and necessary permission for all locations on which the photographer will be performing services. The photographer is limited by the rules and guidelines of the location(s) and site management. The client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the client’s responsibility; the photographer can offer technical recommendations only .

Safety : The photographer reserves to right to terminate coverage and leave the location of the event(s)/shoot(s) if the photographer experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the event(s) or shoot(s); or in the event that the safety of the photographer is in question.

Style : The final post production styles, overall look and editing are left to the discretion of the photographer with the exception of specific requests that the client has made to the photographer in writing.

Image Delivery : The final images provided by the photographer will be delivered within approximately 4 weeks of the session date, unless otherwise specified by the photographer in contract, by email or in person. Depending on the season and workload of the photographer, some projects may be delivered sooner or later than this allowed time. All bookings include delivery via an online gallery with the ability to purchase images from. The link (and password) to this gallery will be provided in an email once your images are ready. This online gallery will be active for 3 months. The client agrees to download this gallery prior to the gallery expiration date. If you are also receiving a USB, this will be delivered to you after your gallery is ready. The USB they are supplied on should be returned if faulty within 14 days. After this time Emily Crutcher Photography has no responsibility regarding the USB. If prints, albums or products are included in your pre-paid package, you will be able to select images and finalize your order as soon as you receive your digital gallery or USB.. The client(s) understands that the USB(s) are for delivery and that the client is responsible for making a back up of their images. If the client loses the images through failure to backup the files, there is an extra charge for a replacement USB. Once your online gallery has expired, there is a £15 fee to re-open your gallery for download and sharing. I can alternatively post a USB drive of your images. This service costs £50 including shipping, labour and product cost.

File Type : The photographer will not supply any unedited or unprocessed RAW files. The photographer will only supply images edited at a standard that the photographer deems appropriate. The client understands that any additional image editing/retouching may incur additional charges.

Professional Training : Photo sessions with Emily Crutcher Photography should not be used as a substitute for professional training or shadowing. Anybody who books a session with the photographer and subsequently establishes their own new business offering photographic services will be invoice a full training fee by Emily Crutcher Photography. Anybody wishing to arrange professional training with the Emily Crutcher Photography can do so directly at any time.

Print/Viewing Guarantee: Emily Crutcher Photography can only guarantee the quality and look of prints and print products that are produced and sold by Emily Crutcher Photography. If you choose to print your digital files via a third party, budget or supermarket printer, the quality of your images may be impaired and your printed images may look discoloured, over-done or different to how they appear on-screen and via my professional printing. I do not recommend having your high quality images printed via a cheap printer for this reason, and you can purchase professional quality products through me and through your gallery, which are 100% guaranteed to look beautiful on your walls or in albums. In regards to viewing guarantees, I cannot guarantee the quality of image viewing on your home monitors or devices that have not been colour calibrated. I recommend that you calibrate your monitor for the best viewing pleasure and image quality.

Products: Any products should be inspected upon collection from client. Once the client agrees to take the products they are accepting they are in satisfactory condition. Once digital files have been transferred they are non-refundable.

Competition Vouchers : These are only valid for 6 months and are non-refundable and non-transferable. They hold no cash value. In the event of cancellation of the original appointment made another appointment can be made but will be charged at the full fee.

Gift Vouchers: These are non-refundable and non-transferable. They hold no cash value. They are only valid for 6 months. If you cancel or do not attend your appointment there is no rearrangement and no refunds.

Retouching, Conversions and Digital Files: Files are automatically lightly retouched and processed to my signature style, and are available in colour and black and white for no added fee. Complex retouching may result in an additional fee. Emily Crutcher Photography, through post production, shall not be performing any of the following:
I cannot make you taller or shorter
I cannot change the colour of your hair, eyes, skin tone etc. beyong any full image treatment such as B&W.
I cannot superimpose different clothing on your body.
I cannot add trademarked/copyrighted images, materials, people, places, or things, such as Mickey Mouse or Justin Beiber.
I cannot produce any images which include defamatory or degrading depictions or language of any kind, illegal acts, or in any way compromise our professional or personal reputations.

Restrictions: Sessions including family sessions are restricted – if you require a large family photo please contact to see if this is possible.
